Terms and Conditions

1. General

These Terms and Conditions apply to all equipment hire, sales, services and production work supplied by M. Daniel Engineering. By accepting a quotation, sending a purchase order or taking delivery of equipment, the customer agrees to these terms.

For the purposes of these terms, “Equipment” means all goods, components and associated items supplied by M. Daniel Engineering, whether hired or sold. “Customer” means the individual, organisation or company entering into the agreement.

These terms are governed by the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the English courts.

2. Quotations and Contracts

A contract is formed when the customer accepts a written quotation, confirms a booking in writing, signs a contract or takes delivery of equipment or services.

Quotations are valid for 30 days unless otherwise stated. MDE reserves the right to substitute equipment with equivalent alternatives where necessary.

All specifications, descriptions and dimensions are approximate and may change without notice.

3. Hire Period and Charges

Hire charges apply from the agreed start date and continue until all equipment has been returned and checked by M. Daniel Engineering.

Equipment must be returned by the agreed date and time, in clean and serviceable condition. Late returns may be charged at the full daily hire rate together with any reasonable losses arising from the equipment being unavailable for other bookings.

The customer remains fully responsible for the equipment until MDE has confirmed its return.

4. Customer Responsibilities

The customer is responsible for ensuring that all equipment is used safely, correctly and only for its intended purpose.

The customer must ensure that any person using the equipment is competent to do so and has received appropriate instruction.

Equipment must not be modified, repaired, sold, sub-hired, transferred or removed from the agreed site without prior written consent from M. Daniel Engineering.

The customer is responsible for providing a suitable and properly earthed electrical supply where required. Any damage caused by incorrect or unsafe power connections will be chargeable.

Any breakdown, damage, fault, theft or accident involving the equipment must be reported to M. Daniel Engineering immediately.

5. Loss, Damage and Insurance

The customer is responsible for the care and safekeeping of all equipment during the hire period.

The customer agrees to pay the full replacement value of any equipment that is lost, stolen or damaged beyond economical repair. The customer is strongly advised to hold suitable insurance covering hired equipment and public liability.

Where equipment is damaged but repairable, the customer shall be responsible for the reasonable cost of repair, cleaning or restoration, together with continued hire charges while the equipment is unavailable for use.

6. Delivery and Collection

Any quoted delivery or collection times are estimates only and may be affected by traffic, venue access or circumstances beyond M. Daniel Engineering’s control.

Delivery and collection charges do not include waiting time, parking charges, tolls or additional attendance unless specifically stated.

The customer is responsible for ensuring suitable access and safe loading or unloading arrangements.

7. Cancellation and Postponement

Bookings cancelled more than 30 days before the hire or event date may be cancelled without charge.

Bookings cancelled between 14 and 30 days before the start date will be charged up to 25% of the quoted amount.

Bookings cancelled between 7 and 14 days before the start date will be charged up to 50% of the quoted amount.

Bookings cancelled within 7 days of the start date will be charged up to the full quoted amount.

Postponement of an event or hire period may be treated as a cancellation where replacement work cannot reasonably be secured.

8. Payment

Unless otherwise agreed in writing, payment is due in accordance with the terms stated on the invoice.

M. Daniel Engineering reserves the right to request deposits or advance payment before confirming a booking.

Late payments may incur interest at 4% above the Bank of England base rate, together with any reasonable costs incurred in recovering outstanding sums.

Title to sold goods remains with M. Daniel Engineering until payment has been received in full.

9. Liability

M. Daniel Engineering’s liability for defective equipment or services shall be limited, at its option, to repair, replacement or refund.

M. Daniel Engineering shall not be liable for indirect or consequential losses, including loss of profit, revenue, business or opportunity arising from delay, breakdown, incompatibility, cancellation or failure of equipment or services.

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded.

The customer is responsible for obtaining any licences, permissions or consents required for the use of copyrighted audio, video or other material.

M. Daniel Engineering accepts no responsibility for any breach of copyright, licensing or performance regulations by the customer.

11. Termination

M. Daniel Engineering reserves the right to terminate a contract immediately and recover equipment if the customer breaches these terms or if M. Daniel Engineering reasonably believes payment or safe use of the equipment is at risk.

The customer authorises M. Daniel Engineering to enter premises where equipment is believed to be located for the purpose of recovery.

12. General

Failure by M. Daniel Engineering to enforce any part of these terms shall not affect its right to enforce them later.

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full effect.

These terms replace any terms proposed by the customer unless expressly agreed in writing by M. Daniel Engineering.
